Terms of Service

The rules that govern access to and use of the LC60 AI websites and online services.

Effective date: 24 May 2026.

1. Acceptance of Terms

These Terms of Service (the “Terms”) govern your access to and use of the websites, content, documentation, contact and enquiry forms, and any related online services (collectively, the “Services”) operated by LC60 AI Pty Ltd (“LC60”, “we”, “us”, or “our”), an Australian company headquartered at Level 9, 1 William Street, Perth WA 6000, Australia.

By accessing or using the Services, you agree to be bound by these Terms. If you are using the Services on behalf of an organisation, you represent that you have authority to bind that organisation, and “you” refers both to you and to that organisation.

If you do not agree with these Terms, you must not access or use the Services.

2. About LC60

LC60 is an Earth intelligence company that designs, builds, and operates satellite-based observation systems and supporting analytics, including (without limitation) the SWIRSAT constellation and the EONET60 analytics platform. The Services described on this website are informational in nature; the commercial products and operational data services that LC60 provides to customers are governed by separate commercial agreements.

3. Use of the Services

You may use the Services only in accordance with these Terms and all applicable laws. Without limiting the generality of the foregoing, you agree not to:

  • Use the Services for any unlawful, fraudulent, or harmful purpose;
  • Attempt to gain unauthorised access to any portion of the Services, related systems, or networks;
  • Interfere with, disrupt, probe, or test the vulnerability of the Services or the infrastructure that supports them;
  • Use any automated means, including scrapers, bots, or data-mining tools, to extract content or data from the Services without our prior written consent;
  • Misrepresent your identity or your affiliation with any person or organisation;
  • Use the Services in any manner that could disable, overburden, damage, or impair them, or interfere with any other party’s use of the Services.

4. Intellectual Property

The Services and all materials made available through them — including text, graphics, logos, icons, images, audio, video, software, satellite imagery, data products, analytics outputs, methodologies, and the selection and arrangement thereof — are owned by LC60 or its licensors and are protected by copyright, trademark, and other intellectual-property laws.

Except as expressly permitted in these Terms or in a separate written agreement with LC60, you may not copy, reproduce, modify, distribute, publish, license, sell, or otherwise commercially exploit any content from the Services.

Limited licence. Subject to your compliance with these Terms, LC60 grants you a limited, non-exclusive, non-transferable, revocable licence to access and view the Services for your internal informational and evaluation purposes.

Trademarks. “LC60”, “SWIRSAT”, “EONET60”, “AG60”, “FMS”, and “ESG Platform”, together with the LC60 logo, are trademarks of LC60 AI Pty Ltd. You may not use these marks without our prior written consent.

5. Submissions and Enquiries

Information you submit through enquiry forms, careers applications, newsletter sign-ups, demo requests, and similar channels is handled in accordance with our Privacy Policy.

By submitting any non-personal information, feedback, suggestion, or idea to LC60 (a “Submission”), you grant LC60 a worldwide, perpetual, irrevocable, royalty-free licence to use, modify, and incorporate that Submission into our products and services without obligation to you. LC60 will treat personal information contained in any Submission as personal information under the Privacy Policy.

6. Products, Pilots, and Commercial Engagements

The Services may describe LC60’s commercial products, planned capabilities, pilot programmes, and customer engagements. Any commercial supply of products, data, analytics, tasking, or professional services by LC60 is governed by a separate written agreement (such as a Master Services Agreement, Statement of Work, or Order Form). In the event of any conflict between such an agreement and these Terms, the separate agreement controls in respect of that commercial engagement.

Forward-looking statements on the Services regarding satellite launches, constellation scale-up, product roadmaps, and target performance are provided for general information and are subject to change. They do not constitute commitments or warranties unless restated in a binding written agreement.

7. Third-Party Links and Services

The Services may contain links to third-party websites, embedded content, or services that are not owned or controlled by LC60. We do not endorse, monitor, or assume responsibility for any third-party content, privacy practices, or business practices. Your interactions with third-party services are governed by the terms and privacy policies of those third parties.

8. Export Controls and Sanctions

Certain LC60 products, data, and technology are subject to Australian export-control laws, the laws of allied jurisdictions, and applicable international sanctions regimes. You agree not to access, use, export, re-export, transfer, or disclose any LC60 information, technology, or service in violation of any such laws, and you represent that you are not located in, ordinarily resident in, or organised under the laws of any jurisdiction subject to comprehensive sanctions, and are not a person or entity with whom LC60 is prohibited from dealing.

9. Disclaimers

The Services are provided “as is” and “as available”, without warranties of any kind, whether express, implied, statutory, or otherwise, to the maximum extent permitted by law. Without limiting the foregoing, LC60 disclaims any warranty of merchantability, fitness for a particular purpose, non-infringement, accuracy, completeness, reliability, and uninterrupted availability.

Nothing in these Terms excludes, restricts, or modifies any consumer guarantee, right, or remedy conferred by the Australian Consumer Law or any other applicable law that cannot lawfully be excluded.

The Services do not constitute professional, legal, financial, operational, or intelligence advice. You are responsible for evaluating the suitability of any LC60 product or information for your specific use case.

10. Limitation of Liability

To the maximum extent permitted by law, LC60 and its directors, officers, employees, agents, and licensors will not be liable for any indirect, incidental, special, consequential, punitive, or exemplary damages, including loss of profits, loss of data, loss of business, loss of goodwill, or business interruption, arising out of or in connection with the Services or these Terms, even if LC60 has been advised of the possibility of such damages.

LC60’s total aggregate liability arising out of or in connection with your use of the Services will not exceed AUD 100, except where higher liability is required by law and cannot lawfully be limited.

11. Indemnity

You agree to indemnify and hold harmless LC60 and its directors, officers, employees, and agents from and against any claims, damages, losses, liabilities, costs, and expenses (including reasonable legal fees) arising out of or related to: (a) your breach of these Terms; (b) your misuse of the Services; or (c) your violation of any law or the rights of any third party.

12. Suspension and Termination

We may suspend or terminate your access to the Services at any time, with or without notice, if we reasonably believe that you have breached these Terms or that your use of the Services may expose LC60 or any third party to legal, regulatory, security, or reputational risk. Sections that by their nature should survive termination (including intellectual-property, disclaimer, liability, indemnity, and governing-law provisions) will survive.

13. Governing Law and Jurisdiction

These Terms are governed by the laws of Western Australia, Australia, without regard to its conflict-of-laws principles. You and LC60 submit to the exclusive jurisdiction of the courts of Western Australia and the federal courts of Australia sitting in Perth for any dispute arising out of or in connection with these Terms or the Services.

14. Changes to These Terms

We may update these Terms from time to time to reflect changes in our Services, our business, or applicable law. The “Effective date” at the top of this page indicates when the Terms were last updated. Your continued use of the Services after an update means you accept the revised Terms.
